Qualifying for DAPA
In order to qualify for DAPA, there are certain criteria that an individual must meet. These things include:
- Lack of lawful status as of November 20, 2014
- Physically living in the United States since November 20, 2014 at the time of submission of an application for DAPA
- Continuous residency in the United States since January 1, 2010
- Being apart from the latest enforcement priorities of the Department of Homeland Security
- Not having characteristics that would prevent a deferred action
When you are ready to submit your Deferred Action Program for Parents application, there will be a fee of $465. The United States Citizenship and Immigration Services agency accepts applications within six months’ time. Waiver fees are not allowed and fee exemptions are very limited. In addition, the Immigration Customs Enforcement agency is typically instructed to recognize fresh migrants and individuals who are in custody who meet the above criteria as they may qualify for deferred action.
Pending Removal Cases
In regard to individuals who have pending removal cases, the ICE can examine such cases and choose to either pursue closure or terminate the case if any of the individuals meet the criteria for deferred action. There may be a process put into place that allows immigrants in removal proceedings to identify themselves as qualified candidates for deferred action.
Information will be protected.
The United States Citizenship and Immigration Services agency will protect all information from applicants during the application process for the DAPA program. It will ensure information protection for the majority of cases for the purpose of immigration enforcement, but any information provided to law enforcement agencies that is fraudulent or where national security is compromised are exceptions.
